By using our website, you confirm your agreement to the website’s terms of use, and you undertake to comply with them. The terms "We" / "Us" / "Our"/” Company” individually and collectively refer to Mayze and the terms "Visitor”” User” “Traveller” refer to the users.
This page states the Terms and Conditions under which you (Visitor) may visit this website (www.mayze.co.in). Please read this page carefully. If you do not accept the Terms and Conditions stated here, we would request you to exit this site. The business, any of its business divisions and / or its subsidiaries, associate companies or subsidiaries to subsidiaries or such other investment companies (in India or abroad) reserve their respective rights to revise these Terms and Conditions at any time by updating this posting. You should visit this page periodically to re-appraise yourself of the Terms and Conditions, because they are binding on all users of this Website.

  1. 1. The Services:
  2. The Services constitute a technology platform that enables users of Mayze websites provided as part of the Services to enquire and book travel services with independent travel agents of such services. Unless otherwise agreed by Mayze in a separate written agreement with you, the Services are made available solely for your personal, non-commercial use. YOU ACKNOWLEDGE THAT MAYZE DOES NOT PROVIDE TRAVEL SERVICES OR FUNCTION AS A TRAVEL AGENT AND THAT ALL SUCH TRAVEL SERVICES ARE PROVIDED BY INDEPENDENT THIRD-PARTY AGENTS WHO ARE NOT EMPLOYED BY MAYZE OR ANY OF ITS AFFILIATES.

  3. 2. Jurisdiction:
  4. Jurisdiction means the geographical area over which a court or government body has the power and right to exercise authority. Parties hereto agree to confer exclusive Jurisdiction to Mumbai Courts / Forums.

  5. 3. Restrictions:
  6. You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Mayze; (iii) reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.

  7. 4. Pre-conditions of registration:
  8. In order to use most aspects of the Services, you must register for and maintain an active personal user Services account ("Account"). You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different than 18), to obtain an Account, unless a specific Service permits otherwise. Account registration requires you to submit to Mayze certain personal information, such as your name, address, mobile phone number and age, as well as at least one valid payment method supported by Mayze. You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access or use the Services. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times.

  9. 5. Text & email Messaging:
  10. By creating an Account, you agree that the WE may send you text (SMS) messages and email as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) and email messages from Mayze at any time. You acknowledge that opting out of receiving text (SMS) and email messages may impact your use of the Services.

  11. 6. Payment, Cancellations, Refund:
    • You understand that once you evaluated the booking option and given your confirmation for booking, you have to pay charges for the services or goods you chose to receive from travel agents. Mayze will facilitate your payment of the applicable Charges on behalf of the Third-Party Provider (Travel agent) as such Third-Party Provider’s limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Third-Party Provider. Charges will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Mayze.
    • All Charges are due immediately upon your confirmation to proceed for booking of services and payment will be facilitated by Mayze using the preferred payment method designated in your Account, after which Mayze will send you a receipt by email.
    • This payment structure is intended to fully compensate the Third-Party Provider for the services or goods provided. You understand and agree that, while you are free to provide additional payment as a gratuity to any Third-Party Provider who provides you with services obtained through the Service, you are under no obligation to do so. Gratuities are voluntary. After you have received services or goods obtained through the Service, you will have the opportunity to rate your experience and leave additional feedback about your Third-Party Provider.
    • In addition to the cost of booking as charged by the Service Providers, Mayze reserves the right to charge certain fees in the nature of convenience fees or service fees. Mayze further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the User before confirming the booking or collecting the payment from such User. Refund of convenience charges will be at the sole discretion of Mayze and will be assessed on case to case basis provided the reasons are genuine and proved after investigation.
    • In cases of short charging of the booking amount, taxes, statutory fee, convenience fee etc., owing to any technical error or other reason, Mayze shall reserve the right to deduct, charge or claim the balance amount from the User and the User shall pay such balance amount to Mayze. In cases where the short charge is claimed prior to the utilization of the booking, Mayze will be at liberty to cancel such bookings if the amount is not paid before the utilization date.
    • Any increase in the price charged by Mayze on account of change in rate of taxes or imposition of new taxes, levies by Government shall have to be borne by the User. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.
    • In the rare circumstance of a booking not getting confirmed for any reason whatsoever, Mayze will process the refund of the booking amount paid by the User and intimate the User about the same. Mayze is not under any obligation to provide an alternate booking in lieu of or to compensate or replace the unconfirmed booking. All subsequent bookings will be treated as new transactions. Any applicable refund will be processed as per the defined policies of the service provider and MAYZE as the case may be.
    • The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the service, as per the applicable laws
    • The User agrees and understands that all payments shall only be made to bank accounts of MAYZE. MAYZE or its agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of MAYZE. The User agrees that if that user transfers any amount against any booking or transaction to any bank account that is not legitimately held by MAYZE or to any personal account of any person, MAYZE shall not be held liable for the same. User shall not hold any right to recover from MAYZE any amount which is transferred by the User to any third party.
    • The User will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents, employees or representatives of MAYZE. The User shall immediately inform MAYZE if such details are demanded by any of its agents' employees or representatives. MAYZE shall not be liable for any loss that the User incurs for sharing the aforesaid details.
    • Refunds, if any, on cancelled bookings will always be processed to the respective account or the banking instrument (credit card, wallet etc.) from which payment was made for that booking.
    • Booking(s) made by the User through MAYZE are subject to the applicable cancellation policy as set out on the booking page or as communicated to the customers in writing.
    • Cancellation and refund will not be processed on Sunday, public holidays and 24 hours before departure or travel date.
  12. 7. Insurance:
  13. Unless explicitly provided by Mayze or Travel agent in any specific service or deliverable, obtaining sufficient insurance coverage is the obligation of the User. In no case Mayze shall accept any claims arising out of such scenarios.

    Insurance, if any provided as a part of the service or product by Travel agent shall be as per the terms and conditions of the third-party insurance company. Mayze or Travel agents merely acts as a facilitator in connecting the User with insurance company. The User shall contact the insurance company directly for any claims or disputes. Mayze shall not be held liable in case of partial acceptance or denial of the claims by the insurance company.

  14. 8. Force Majeure:
  15. Force Majeure means an event or circumstance not within the reasonable control, directly or indirectly, of Mayze in its ability to perform its obligations/ responsibilities regarding the tour including

    • war, hostile invasion, act of foreign enemies;
    • rebellion, revolution, insurrection or military or usurped power or civil war;
    • epidemic, explosion, fire, flood, earthquake or other exceptional natural calamity and act of God;
    • ionizing radiation or contamination by radioactivity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radioactive toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly;
    • riot, commotion or disorder;
    • any act or omission of any Government instrumentality;
    • a change in Legal Requirements;
    • strikes, lockouts or other industrial disturbances; &
    • abnormal weather or sea conditions including tempest, lightning, hurricane, typhoon, rain & temperatures.
  16. 9. Third Party Services and Content:
  17. The Services may be made available or accessed in connection with third party services and content (including advertising) that Mayze does not control. You acknowledge that different terms of use and privacy policies may apply to your use of such third-party services and content. Mayze does not endorse such third-party services and content and in no event shall Mayze be responsible or liable for any products or services of such third-party providers. Mayze shall not be responsible for services provided by third parties.

  18. 10. Intellectual Property Rights
  19. The Services and all rights therein are and shall remain Mayze’s property or the property of Mayze’s licensors. Neither these Terms nor your use of the Services convey or grant to you any rights: (i) in or related to the Services except for the limited license granted above; or (ii) to use or reference in any manner Mayze’s company names, logos, product and service names, trademarks or services marks or those of Mayze’s.

  20. 11. Liability:
  21. The liability of Mayze is restricted only to the facilitating interaction with traveller and travel agent. It is the sole responsibility of traveller to make sure that all the information provided are right and any discrepancy in booking is highlighted appropriately as per the terms and conditions for refund and cancellation. Company is not liable for any loss of person or property caused or damaged or suffered by the guest/s on account of deficiency in services by any independent contractor. Any gesture of courtesy extended by Mayze to the guest/s to minimize such loss or damage shall not constitute an admission of such liability or a waiver. Mayze shall in no circumstances whatsoever be liable to the guest/s or any other person for any loss or expenses incurred due to theft or any other reason whatsoever during the tour and the entire responsibility of taking care of their valuables shall be that of the guest/s.

    • Train/flight delays, on account of any reason whatsoever rescheduling/cancellation of train / flights inter-connection meals not being served etc.
    • Any overstay expenses on account of any delay or changes in air, bus, ship, train or cancellation of special bogie on account of Force Majeure including weather conditions, strike, war, quarantine, or any other reason whatsoever,
    • Any Sightseeing missed and/or the program being curtailed after commencement of the tour and/or before the due period on account of Force Majeure including any unavoidable circumstances and any reason beyond company control including political, natural calamity, monument under renovation, VIP movement and security, heavy rush at sightseeing places, road traffic congestion etc.
    • Any tour, holiday, excursion facility exceeding the total amount paid or agreed to be paid by the guest/s for the tour, including any consequential loss or additional expense whatsoever if the guest/s is not allowed to board the train/flight on account certain reasons beyond the control of Mayze.
    • Any loss of baggage by independent contractor or their agents, hotel staff, bus/coach or during tour including damage or loss caused to the guest due to Force Majeure, negligence or technical fault or any other reason whatsoever on account of any change, amendment or cancellation in their schedule by Airline/Railway Authority.
    • Allocation of seats, and food service in the aircraft.
    • Any celebrity assigned for the tour as an entertainer not turning up on the tour due to the reasons beyond the control of Mayze.
    • Any personal injury, sickness, accident, loss, delay, discomfort, consequential loss and/or damage or any damage to baggage or personal effects howsoever caused.
    • Death of the guest while on tour and all applicable rules and procedures of law are to be followed strictly and all the procedures pertaining to the death shall have to be tackled and handled by the guest or their relatives themselves at their own cost and consequences.
    • Any injury, loss, personal harm, death or damage caused to any person or property by the act or default of the management / employees / agents of any independent contractor.
  22. 12. Terms and Conditions- Pre-booking
    • Domestic Tour

        Role of Mayze and Limitation of Liability

      • MAYZE does not control or operate any airline, shipping company, coach, hotel, transport vehicles, restaurant, kitchen caravan, tour bus, tour van, tour car or any other facility or service utilised during tour.
      • MAYZE shall not be responsible for any delay, improper service, standard of service provided by any service provider or any Independent Contractor, or for any injury, death, loss or damage which is caused by the act or default of any hotel, airlines, shipping companies, cruise, coach owners, tour operators who are MAYZE's independent contractors.
      • MAYZE shall not be responsible for any act or actions of co-travelers, co-passengers which may result in injury, damage to the life or limb or property of the User, or which may lead to interference in enjoying or availing the services provided on the outbound tour. Guest/s hereby acknowledges that all the guest/s who have booked the tour have gone through the itinerary and is well-aware about the same and all the guest/s are medically fit to undertake the said tour
      • MAYZE being merely a facilitator, shall not be liable for the following:
        • Personal injury, sickness, accident, death, loss, delay, discomfort, increased expenses, incidental, consequential loss and/or damage or any kind of theft howsoever caused to the User or any person travelling with them.
        • Any act, omission, default of any travel agent or third party or any other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the User or for any person traveling with him /her.
        • The temporary or permanent loss of, or damage to, baggage or personal belongings howsoever caused including wilful negligence on the part of any person.
        • Any delay made in delivery of the service by the concerned service providers.
        • Failure on the part of airline to accommodate passengers despite having confirmed tickets for any reason whatsoever including overbooking, change of route etc. or failure on part of hotel to allow check-in despite confirmed booking for whatever reason.
        • Any claims of any dispute with the travel agent and tour manager.
        • Any claim arising due to delay at the airport and if the User has to wait at the airport or at the hotel for check-in due to any technical snag or any other reason not attributable to MAYZE, MAYZE shall not be liable for making any arrangements, including but not limited to food or any hotel arrangement in case of such delays.
        • Any damages caused to the User due to reasons beyond the control of MAYZE.
      • In no event shall the entire liability of MAYZE for any claims directly and indirectly arising out of the tour exceed the total booking amount paid by the User.
      • There can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honour the confirmed bookings due to various reasons like climatic conditions, labour unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If MAYZE is informed in advance of such situations where dishonour of bookings may happen, it will make its best efforts to provide similar alternative to its User or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The User agrees that MAYZE being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. The maximum liability of MAYZE in such events will be to refund the booking amount subject to receipt from the service providers. Persons, friends or relatives of the guest/s, who have not booked the tour shall not be allowed in hotel rooms, restaurants, coaches and sight-seeing places or for any activity on the tour. A transfer from the originally booked tour to another tour is treated as cancellation of earlier tour and therefore a fresh booking of another tour has to be made. All cancellation charges shall apply on tour tariff and not on discounted tour tariff for the earlier booked tour. The tour tariff and discounts available / given for the cancelled tour are not valid for fresh booking. Tour tariff and discounts prevailing on the date of fresh booking of another tour shall be applicable.
    • Bus
      • Limitation of Liability of Mayze

        In its role as a technology platform provider to facilitate transactions between the Users and the Agents and agents facilitate transaction between the bus operator on behalf of the traveller. Mayze or agent shall not be responsible for the operations of the bus operator including, but not limited to the following:

        • Timely departure or arrival of the bus;
        • The conduct of bus operator's employees, representatives or agents;
        • The condition of the bus, seats etc. not being up to the customer's expectation or as per the description provided by the bus operator;
        • Cancellation of the trip due to any reasons;
        • Loss or damage of the baggage of the customer;
        • The bus operator changing a customer's seat for any reason whatsoever;
        • Bus operator informing a wrong boarding point for the issuance of the booking confirmation voucher, or changing such boarding point eventually with or without any notification to Mayze or the User;
        • Bus operator using a separate pick-up vehicle to transport the User from the designated boarding point to the actual place of departure of the bus.
      • Responsibility of User

        It is the responsibility of the user to make sure that all the information about the traveller is provided correctly for booking. It is the responsibility of the user to get all the clarification from the agent from whom he has opted to proceed for booking through our interactive platform.

        Once the booking confirmation is received by the user it is his responsibility to check and ensure all the details are correct. It is also the responsibility of the user to cross check the booking with the actual service provided directly based on the detailed information provided on the booking confirmation or ticket.

    • Train
      • Limitation of Liability of Mayze

        Mayze only acts a technology platform interface between Agents and user. Agents only acts as a facilitator for booking of train tickets on behalf of traveller for desired train tickets to be booked through IRCTC by the agent. Once the traveller has assessed the options and provided his confirmation for booking after making payment within the stipulated time, the travel agent will make all efforts to complete the booking within the stipulated time and sent in the booking confirmation. In case of failure to complete the booking, full refund will be processed back to the traveller. All bookings or train reservations made through Mayze and Agents are subject to the applicable Terms & Conditions as set out by Indian Railways.

        Mayze and Agents have no control over the booking flow, scheduling/re-scheduling, cancellations, confirmation from RAC to confirmed, delays, meal and berth preferences or any other lack or deficiency of services. Liability, if any, for the above-said stands against the Indian Railways.

        Train functionality on the Website will not be functional between 2345 hours to 0030 hours or as specified by IRCTC due to system downtime or any other reason beyond the control of Mayze and Agents.

      • Responsibility of User

        It is the responsibility of the user to make sure that all the information about the traveller is provided correctly for booking. It is the responsibility of the user to get all the clarification from the agent from whom he has opted to proceed for booking through our interactive platform.

        Once the booking confirmation is received by the user it is his responsibility to check and ensure all the details are correct. It is also the responsibility of the user to cross check the booking with the actual service provided directly based on the detailed information provided on the booking confirmation or ticket.

      • Payments for bookings and cancellations

        Mayze service charges are non-refundable unless otherwise determined by Mayze.

        Bookings can only be cancelled through the app or the website; offline cancellations are not permitted.

        The bookings made on MAYZE's Site are subject to cancellation policy and charges levied by the Indian Railways. It may vary depending on the cancellation time and booking quota (tatkal/ general/ ladies/ premium etc.).

        Railways automatically cancel the fully waitlisted e-tickets after chart preparation. The refund in such cases gets automatically credited to your bank account used for booking such tickets after deduction of MAYZE's charges.

        Railways may offer special concessions/ discounts for senior citizens, female passengers and children. The amount or extent of concession is not decided by MAYZE. All customers are advised to check latest railways policies for applicable discounts.
